englischUntil 2013, the long-distance bus traffic tended to be sidelined. This thesis examines the legal basics of a liberalisation of the domestic long-distance bus market. The traditional licensing regime of passenger transport legislation protecting railway traffic was put to the test not only politically but also in recent jurisdiction and Union law and ultimately could not be upheld because of European and constitutional legislation.

Against this backdrop, the thesis highlights the legal framework and scope for the design of liberalisation and discusses the relationship to services for the public and the railway. The insight gaines leads to possible liberalisation models of varying intensity and forms the standard to test the amandment to the PBefG (Passenger Transport Act) in 2013, which for the first time led to a widespread opening of the domestic long-distance bus market; for establishing an overall traffic system, however, this requires improvement.
