englischThe European Commission bears the burden of proof for factual requirements regarding the prohibition of cartels under Article 101 (1) TFEU. If the Commission succeeds in proving the elements of this article, the undertakings involved in a cartel are liable to heavy fines. Hence, how undertakings may abandon themselves from a cartel is an extremely relevant question in practice. The so-called "public distancing" is the most important instrument available to undertakings and is therefore the subject of numerous decisions of the EGC and CJEU. This thesis examines the dogmatic classification and pursues the question under which conditions a successful public distancing must be fulfilled and which legal function is assigned to this instrument.
