englischThe use of AI in medicine is revolutionizing healthcare, but also raises new liability issues. The author examines whether European product liability law is applicable to AI-based medical devices and can provide an appropriate balance of risks between manufacturers and users. For this purpose, all liability requirements are analyzed and a standard for defectiveness assessment of AI-based medical devices is defined, which takes into account both the characteristics of AI and the specifics of medical devices. In a postscript, the drafts of the new Product Liability Directive and the AI Liability Directive published by the European Commission at the end of 2022 are discussed.

 

The work was awarded the Medical Device Law Science Prize 2023.
