englischDivergent court rulings have given cause to legal uncertainty in the German leasing industry as to the proper notification of consumers with respect to their right of withdrawal from mileage-based leasing contracts – with considerable implications: The consumer has a prolonged or even “eternal” withdrawal rightand without any obligation by the lessee to pay compensation. This monograph examines the contractual classification of the mileage-based leasing contract on the basis of model contracts as well as the questions referred for a preliminary ruling by the the ECJ and is of practical relevance for leasing experts.
