For the first time, the author classifies the relationship between headhunters and applicants from a legal point of view and drafts a mutual canon of duties. This relation presents legal complexities due to the interaction with the charging employer. The author draws parallels to the cases of a „professional liability“ and describes how this constellation of three people has to be recorded from a legal point of view. The focal point is personnel consulting (Executive Search, Management Audit, Outplacement). Expert interviews with partners of leading recruitment agencies contributed to the work in order to achieve practice-oriented results.
