englischReentering employment after family-related timeouts from work has proven to be a legally challenging process which has a high potential for discrimination and is of signal importance for the further career paths of employees concerned. The Parental Leave Directive 2010/18/EU contains specific regulations tailored to this situation which will be examined in the present thesis. The right to return to the previous job and the right to negotiate changes of the work arrangement are complementary to the guiding principle of 'controlled flexibility' and go beyond formal equal treatment in order to protect employees from feared and de facto discrimination by using parental leave. Those requirements are compared and balanced with the German legal situation, deficits are identified and possible solutions are developed.
