englischThis paper deals with the relationship of § 265d StGB to sports law. According to this author’s opinion, the criminal liability of § 265d (1) and (2) StGB also presupposes a violation of the relevant sports rules by the beneficiary. Therefore, various questions arise, for example who is to rule on a violation of sports rules in a criminal case. In this regard, special features of competitive sport are discussed from the creation of the rules to their enforcement. Furthermore, it is examined using various examples whether sports related decisions of associations predetermine the criminal case.
