englischThe study is dedicated to the criminal law risks of investigative journalism on the Europeanized capital market. The reporting of the Financial Times on Wirecard AG is used as an example. It is shown that journalists can in principle be subject to the ban on the unlawful disclosure of insider information and the ban on information-based market manipulation. The author resolves this conflict with the freedom of the media under Art. 11 CFR on the basis of Art. 21 MAR. As part of a balancing exercise, it is shown that honest journalists are not subject to the prohibitions of the MAR. The study not only presents the traditional media, but also looks at social media.
Die Arbeit widmet sich den strafrechtlichen Risiken des investigativen Journalismus am europäisierten Kapitalmarkt. Hierbei wird als Beispiel die Berichterstattung der Financial Times über die Wirecard AG herangezogen. Es wird aufgezeigt, dass Journalisten im Grundsatz dem Verbot der unrechtmäßigen Offenlegung von Insiderinformationen und dem Verbot der informationsgestützten Markmanipulation unterliegen können. Dieses Spannungsfeld zu der Medienfreiheit aus Art. 11 GRCh löst der Autor anhand Art. 21 MAR auf. Im Rahmen einer Abwägung wird aufgezeigt, dass redliche Journalisten im Ergebnis nicht den Verboten der MAR unterliegen. Die Arbeit stellt nicht nur die traditionellen Medien dar, sondern nimmt sich auch den sozialen Medien an.
