englischThe study is dedicated to the criminal law risks of investigative journalism on the Europeanized capital market. The reporting of the Financial Times on Wirecard AG is used as an example. It is shown that journalists can in principle be subject to the ban on the unlawful disclosure of insider information and the ban on information-based market manipulation. The author resolves this conflict with the freedom of the media under Art. 11 CFR on the basis of Art. 21 MAR. As part of a balancing exercise, it is shown that honest journalists are not subject to the prohibitions of the MAR. The study not only presents the traditional media, but also looks at social media.
