englischThe German Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz ZAG) of 2009 comprises new criminal offences. Those are of relevance not only for the classic players on the market and the fintec scene but also for businesses of the services and entertainment sectors offering additional services regarding the processing of payments and transactions of funds.

The author analyses and elaborates the individual criminal offences and their prerequisites in detail and clarifies the specific terminology of payment services legislation. He concludes with a critical evaluation of individual provisions with regard to the principle of clarity and legal certainty. In an additional chapter, he gives an overview of potential changes that may result from the transposition of the new Payment Services Directive of 2015 into German legislation.
