englischA customer insults a member of staff because of his skin colour, an employee makes sexually suggestive comments towards his colleague, the hired staffing firm excludes elder applicants from the application process. Cases like these raise the question to what extent the employer is responsible for such conduct.

The aim of this dissertation is to structure the responsibility of the employer for discriminatory conduct of third parties. Thereby it is examined how the duty of the employer to act according to the „Allgemeines Gleichbehandlungsgesetz (AGG)“ fits into the existing legal doctrine of the German civil law.
