englischThe book addresses unresolved issues about the compensation of employee-inventors in case of insolvency in Germany. Due to Sec. 9 of the German Employee Inventions Act, employees receive compensation in addition to their salary if they make an invention during working time. Sec. 27 of the German Employee Inventions Act stipulates special rules for this additional compensation in case the employer becomes insolvent. The aim of the scheme is to protect the compensation of the employee in this situation. As a result of the special protection of the employee’s invention compensation in case of insolvency, it is harder to restructure the company of the insolvent employer.

The book tries to find an interpretation of Sec. 27 German Employee Inventions Act that simplifies the restructuring of the insolvent employer.
