englischThis is the first monograph to address the limitation of claims for damages in lieu of performance and claims to the continued effect of a right (“Rechtsfortwirkungsanspruch”). Do these claims expire in accordance with the primary performance claim and claim to surrender (Section 985 German Civil Code), which they replace? Or does the respective claim for compensation always expire independently? The former is the case. The otherwise imminent loss of function of Section 213 Alt. 2 German Civil Code proves, inter alia, that Sections 281, 283 German Civil Code do not expire any later than the primary performance claim. A comparison with Section 977 German Civil Code establishes that the limitation of Sections 816 Para. 1 S. 1, 951 Para. 1 German Civil Code depends on the 30-year limitation of the claim to surrender.
