englischIn January 2017, a colloquium took place at the Higher Regional Court in Düsseldorf on the occasion of the 75th birthday of Franz Jürgen Säcker. The colloquium opened with a welcome speech by the President of the Higher Regional Court in Düsseldorf, Anna José Paulsen. Following an acknowledgment of Franz Jürgen Säcker by Professor Jochen Mohr, the President of the Federal Supreme Court of Germany, Bettina Limperg, outlined the “Energy Law before the Federal Supreme Court”. After that Jochen Homann, President of the German Federal Network Agency, explicated the tasks of the regulatory authority in the context of the “Energiewende” (the transition in energy production and use). Wiegand Laubenstein, chairman of the 3rd Cartel Senate of the Higher Regional Court in Düsseldorf, illustrated the jurisdiction of his senate. Thereupon, Constantinos Iliopoulos, a judge at the European Court of First Instance, undertook a thorough analysis of the intergovernmental agreement on the Trans-Adriatic-Pipeline. Professor Jürgen Kühling dealt with the tension between competition and common welfare. Subsequently, Attorney Frank Montag discussed problems related to European merger control. Finally, Franz Jürgen Säcker advocated that the energy law stay in the “good hands” of civil jurisdiction.
