englischThe work examines in detail the complex relationship between the traditional human inventorship and protectability of AI-generated inventions. The analysis of the current legal situation discloses that only a natural person can be considered as an inventor. The author answers the question of the requirement of patent protection for "inventorless" AI-generated inventions by taking into consideration historical, sociopolitical, legal and economic factors. On this basis, different options for the legal framework de lege ferenda are discussed and a concrete proposal for the protection of these inventions is made.
