The author answers these questions with particular attention to the appointment of judges. So far, the debate on the administration of the judiciary has focused on constitutional law, comparative law and legal policy aspects. The author now seeks to include the perspective of European Union law. To this end, he analyses the European Union’s legal framework on the independence of the judiciary in light of recent case law of the European Court of Justice and the European Court of Human Rights.
Lassen sich aus dem Unionsrecht Vorgaben für die Ausgestaltung der deutschen Gerichtsorganisation ableiten? Der Autor beantwortet diese Frage mit besonderem Augenmerk auf die Richterbestellung, indem er das unionsrechtliche Normengefüge zur Unabhängigkeit der Justiz unter Berücksichtigung der neuen Rechtsprechung des Europäischen Gerichtshofs und des Europäischen Gerichtshofs für Menschenrechte analysiert. Damit erweitert er die bislang unter verfassungsrechtlichen, rechtsvergleichenden und rechtspolitischen Gesichtspunkten geführte Debatte, wem die Verwaltung der Dritten Gewalt obliegt, um die unionsrechtliche Betrachtungsweise.
