englischThe protection of temporary agency workers is commonly treated simply as the antithesis of corporate needs for flexibility. More important, however, is its role in the fragmenting effect of temporary agency work. On the basis of the legal and actual framework conditions, Paul Kolfhaus highlights the mechanisms at work in temporary agency work. According to his analysis, the considerable undercutting of the principle of equal treatment observed in collective bargaining agreements is contrary to European Union law; the required overall protection of temporary agency workers can today only be guaranteed in a roundabout way. As an alternative, the author points to the structural advantages of a mandatory obigation to equal treatment.
