More important, however, is its role in the fragmenting effect of temporary agency work. On the basis of the legal and actual framework conditions, Paul Kolfhaus highlights the mechanisms at work in temporary agency work. According to his analysis, the considerable undercutting of the principle of equal treatment observed in collective bargaining agreements is contrary to European Union law; the required overall protection of temporary agency workers can today only be guaranteed in a roundabout way. As an alternative, the author points to the structural advantages of a mandatory obigation to equal treatment.
Der Schutz von Leiharbeitskräften wird gemeinhin schlicht als Gegenpol unternehmerischer Flexibilitätsbedürfnisse behandelt. Gewichtiger ist aber seine Rolle bei der fragmentierenden Wirkung der Arbeitnehmer*innenüberlassung. Auf Basis der rechtlichen und tatsächlichen Rahmenbedingungen stellt Paul Kolfhaus die in der Leiharbeit wirkenden Mechanismen heraus. Die dabei beobachtete erhebliche tarifliche Unterschreitung des Gleichstellungsstandards ist nach seiner Analyse unionsrechtswidrig; der geforderte, ihm zufolge relativ zu verstehende Gesamtschutz von Leiharbeitskräften kann heute nur auf Umwegen garantiert werden. Als Alternative dazu verweist der Autor auf die strukturellen Vorteile einer zwingenden Gleichstellungspflicht.
