The author argues that the introduction of § 217 StGB has been accompanied by effects on the status of patient autonomy beyond its scope of application. She discusses the resulting current challenges for patient autonomy, but also points out opportunities for the significance of patient autonomy at the end of life.
Die Arbeit vergleicht und analysiert den von der Rechtsordnung zugedachten Stellenwert der Patientenautonomie am Lebensende vor und nach Einführung des § 217 StGB. Leitfrage der Untersuchung ist, ob die mit Einführung des § 217 StGB erfolgte Teilkriminalisierung der ärztlichen Suizidassistenz als Ausdruck eines Paradigmenwechsels begriffen werden kann: Ist die Teilkriminalisierung symptomatisch für einen wiedererwachenden medizinstrafrechtlichen Paternalismus, der – weit über den Regelungsbereich der geschäftsmäßigen Förderung der Selbsttötung hinaus – die Patientenautonomie am Lebensende insgesamt erfasst?
Die Autorin legt dar, dass die Einführung des § 217 StGB über seinen Anwendungsbereich hinaus mit Auswirkungen auf den Stellenwert der Patientenautonomie einhergegangen ist. Sie erörtert die hieraus resultierenden aktuellen Herausforderungen für die Patientenautonomie; zeigt aber auch Chancen für den Stellenwert der Patientenautonomie am Lebensende auf.
