englischEmotion-recognizing algorithms pose challenges for users of data protection law in the multi-level system of the EU. While technology-specific regulations are lacking, the value system of the German constitution attaches a different significance to the handling of emotional data than the basic charter law: In European Union law, self-determination is not condensed into sole determination.

 

This work analyzes the factual and legal peculiarities of data processing by means of emotion-recognizing algorithms, identifies potentials for regulation under simple and secondary law - along with their limits under constitutional law - and finally proposes (technology-)specific design guidelines for dealing with emotional data.
