Almost every Internet user has come across this notice at some point when trying to access cross-border audiovisual content. The reason for this is the territoriality of copyright, which grants each author a bundle of national copyrights. However, this territorial division and the resulting use of geoblocking is in conflict with the EU objective of creating a digital single market with cross-border access options. This work examines this conflict from the perspective of copyright and antitrust law, as well as the Portability Regulation and the Online SatCab Directive.
„Der gewünschte Inhalt ist in diesem Land leider nicht verfügbar“. Über diesen Hinweis ist fast jeder Internetnutzer schon einmal bei dem Versuch, grenzüberschreitende audiovisuelle Inhalte abzurufen, gestolpert. Ursache dafür ist die Territorialität des Urheberechts, welche jedem Urheber ein Bündel nationaler Urheberrechte gewährt. Diese territoriale Aufspaltung und die daraus resultierende Verwendung von Geoblocking steht jedoch im Spannungsverhältnis zu dem EU-Ziel, einen digitalen Binnenmarkt mit grenzüberschreitenden Zugriffsmöglichkeiten zu schaffen. Das vorliegende Werk untersucht dieses Spannungsverhältnis unter urheber- und kartellrechtlichen Aspekten sowie die Portabilitäts-Verordnung und die Online-SatCab-Richtlinie.
