englischIn the compilation volume "Foundations of System Formation in Agricultural Law", the dogmatic deficit of an incomplete elaboration of the principles of agricultural law that has existed up to now is addressed and this gap is filled. The theoretical findings and their verification are discussed based on the legal systems of Germany, Austria and Switzerland. The elaboration of these structural principles of agricultural law should help the legislator, the administration and the judiciary to develop a coherent system of agricultural law. The contributions consider the legal situation as of 1 November 2021 (with a view to the CAP reform coming into force on 1 January 2023).
In dem Sammelband „Grundlagen der Systembildung im Agrarrecht“ wird das bis dato bestandene dogmatische Defizit einer unvollständigen Herausarbeitung der Prinzipien des Agrarrechts angegangen und diese Lücke gefüllt. Die theoretischen Erkenntnisse und deren Überprüfung werden anhand der Rechtsordnung Deutschlands, Österreichs und der Schweiz diskutiert. So soll die Herausarbeitung dieser strukturprägenden Prinzipien des Agrarrechts dem Gesetzgeber, der Verwaltung und der Justiz helfen, ein kohärentes Agrarrechtssystem zu entwickeln. Die Beiträge berücksichtigen die Rechtslage zum 1. November 2021 (mit Ausblick auf die am 01.01.2023 in Kraft tretende GAP-Reform).
