englischThis volume outlines an organisational form for research collaborations and thus aims to contribute to the development of enabling law in the scientific field. Since Corporate Governance is tailored to businesses rather than research activities, the author develops a Collaborative Research Governance approach in order to legally reflect on both the scientific task and the cooperative objective of the association. Consequently, the organisational design adheres to the fundamental requirement of scientific adequacy. The author argues that it is therefore necessary to establish an autonomous scientific management and to ensure every researcher’s participation in the development of the cooperation.
Die Arbeit skizziert eine Organisationsform für Forschungskooperationen und will damit zur Schaffung rechtlicher Infrastrukturen im Wissenschaftsbereich beitragen. Ausgehend von der Feststellung, dass die gesellschaftsrechtlichen Handlungsformen nicht auf wissenschaftlichen Erkenntnisgewinn zugeschnitten sind, wird der Corporate-Governance-Ansatz fortentwickelt zur Collaborative Research Governance, um die wissenschaftliche Aufgabenstellung und die kooperative Zielfunktion rechtlich abzubilden. Dies macht eine in wissenschaftsrelevanten Fragen autonome Leitung und die Teilhabe der WissenschaftlerInnen am Kooperationsgeschehen erforderlich. Beides folgt aus dem verfassungsrechtlichen Gebot wissenschaftsadäquater Organisationsstrukturen.
