englischTaner Aydin examines the legal philosophies of the two most important and influential German-speaking legal philosophers of the 20th century, Gustav Radbruch and Hans Kelsen, in relation to a central event in their biographies that is also suitable to test their legal philosophies: the experience of National Socialism.

 

The author relates the premises of the respective legal philosophy to their statements on Nazi law. With respect to Radbruch, the author shows, among other things, that the experience of National Socialism has led to a correction of a foreign element in his legal philosophy. With regard to Kelsen, the author elaborates that he has too easily given comprehensive legal quality to all Nazi law.
