englischThe thesis deals with contractual and tort liability issues for artificial intelligence in current and future law. Autonomous Systems push, due to their risks (autonomy, networking and intransparency), classical legal doctrine to its limits. Therefore, the work advocates a regulatory legal dogmatic approach in order to holistically delimit the spheres of responsibility of the parties involved (contractual partners, manufacturers, users and third parties). The thesis advocates major changes in current substantive law and the burden of proof. For future law, the dissertation presents a co-regulated "tiered structure of liability" (including a fully formulated draft EU-regulation) and thus promotes innovation in technology law.
Die Arbeit behandelt die vertrags- und deliktsrechtlichen Haftungsfragen für Künstliche Intelligenz de lege lata und de lege ferenda. Autonome Systeme bringen aufgrund ihrer Risiken (Autonomie, Vernetzung und Intransparenz) die klassische Rechtsdogmatik an ihre Grenzen. Die Arbeit vertritt daher einen modernen regulatorisch-rechtsdogmatischen Ansatz, um holistisch die Verantwortungssphären der Beteiligten (Vertragspartner, Hersteller, Anwender und Dritte) im geltenden materiellen Recht und der Darlegungs- und Beweislast abzugrenzen. Die Arbeit knüpft im zukünftigen Recht daran unional einen ko-regulierten „Stufenbau der Haftung“ (samt ausformulierten Verordnungs-Entwurf) an und fördert damit die Innovation im Technikrecht.
