englischThe contract types stipulated in the German Civil Code (“BGB”) in the form standardized in the BGB do not sufficiently reflect the legal requirements of software projects using the Scrum method .This thesis examines the possibilities to what extent contract design can provide provisions that are in the interest of both parties to the contract. Starting with an overview of agile software development, the suitability of the standardized BGB contract types for software projects using the Scrum method is examined. The main part of the thesis evaluates practically orientated possibilities of contract design for those subjects of regulation, which are only insufficiently or not at all represented by the BGB contract types as stipulated in the BGB.
Die BGB-Vertragstypen in der im BGB normierten Form bilden die rechtlichen Anforderungen von Softwareprojekten im Scrum-Verfahren nicht hinreichend ab. Diese Arbeit untersucht die Möglichkeiten, inwiefern durch Vertragsgestaltung dennoch für beide Vertragsparteien interessengerechte Regelungen erreicht werden können. Beginnend mit einem Überblick über agile Softwareentwicklung wird daran anknüpfend die Eignung der normierten BGB-Vertragstypen für Softwareprojekte im Scrum-Verfahren untersucht. Im Hauptteil der Arbeit werden dann für diejenigen Regelungsgegenstände, die durch die im BGB normierten BGB-Vertragstypen unzureichend oder gar nicht abgebildet werden, praxisorientierte Regelungsmöglichkeiten durch Vertragsgestaltung dargestellt.
