englischFrom a traditional point of view, prohibitions of discrimination require a specific legitimation in private law. Based on the case law of the ECJ, the author examines against this background to what extent the prohibitions of discrimination on grounds of nationality under EU primary law are binding for private individuals. The focus of the work is on the question what special grounds for legitimation exist for a horizontal effect of the prohibitions of discrimination under primary law and its compatibility with private autonomy. On this basis, the study presents the specific requirements of conduct that arise for private individuals from such horizontal effect and shows possible legal consequences of unlawful discrimination.
