englischImplicit bias influences employers in their decision-making. How should a legal framework react to such unconscious discriminatory behaviour? In a first step, the author examines whether implicit bias is within the scope of Germany’s antidiscrimination law (Allgemeines Gleichbehandlungsgesetz). Subsequently, his analysis is about the question of whether the legal consequences stipulated in the AGG are an effective and proportionate approach to reducing the influence of implicit bias on decision-making processes. The main weak spot within the framework is § 15 paragraph 2 of the antidiscrimination law because it determines a penalty without culpability and therefore offers no incentive for the employer to actively curb any implicit bias they might harbour.
