englischThis dissertation deals with the scope of application of Germany’s Freedom of Information Act and the extent to which it offers the public the right to access parliamentary information. After explaining the foundations and objectives of the right to information, as well as the structure and contents of the Freedom of Information Act, the study describes the function and structure of the Bundestag and, finally, examines the concrete application of the law, focusing specifically on the German Parliament. It demonstrates that, at present, there are several tools which can be used to access parliamentary information directly. This situation thus creates an open information society with regard to Parliament. However, there are a number of exceptions in the Freedom of Information Act and restrictions regarding measures taken by Parliament. Consequently, the application of the act is confined by these limitations.
Die Dissertation widmet sich der Frage nach Anwendungsfeldern und Reichweite des allgemeinen Informationszugangsanspruchs nach dem IFG des Bundes im parlamentarischen Bereich. Sie arbeitet sich dabei vom Allgemeinen zum Besonderen vor und bietet zunächst einen generellen Überblick über Grundlagen und Ziele des Informationsrechts sowie Struktur und Inhalte des IFG, bevor es sich spezifischer mit Funktionen und Organstruktur des Bundestages und schließlich mit der konkreten Anwendung des Gesetzes in Fallgestaltungen mit Parlamentsbezug befasst. Mit Blick auf die Kernfrage, inwieweit mit dem IFG des Bundes dem Bürger nunmehr auch im parlamentarischen Bereich ein adäquates Mittel zur Verfügung steht, um Zugang zu staatlichen Informationen zu erlangen, zeigt die Untersuchung dabei ein gemischtes Ergebnis auf: Das IFG birgt insoweit zwar durchaus gute Ansätze, letztlich hält sich der erreichte Zugewinn an individueller Informationszugangsfreiheit aber doch in einem überschaubaren Rahmen.
