englischThe use of legally non-binding norms is neither a novelty nor rare in European Union law. Nevertheless, many questions concerning these instruments have still not been conclusively answered. This book takes a close look at their use in energy and state aid law, focusing in particular on whether and how they can be categorised. In addition, their effects, both de jure and de facto, the legal limits of their use, and the question of judicial review are examined. It is shown that perceived certainties about “soft law” must be questioned and that the problems raised by these instruments should be addressed above all at the level of transparency.
