englischThis dissertation is the first comprehensive study of the Novel Food Regulation (EU) 2015/2283, which regulates the marketing of novel foods in Europe’s internal market. Novel foods bear witness to the great innovative power of the food sector, but they often involve unknown health risks. Applying the precautionary principle, the EU is striving to control these risks by means of a central European authorisation procedure. This dissertation therefore focuses on the question of whether general European administrative procedural law can strike a proportionate balance between risk control on the one hand and the legal system’s openness to innovation on the other. Its findings are conflicting: Although European administrative law offers sufficiently efficient structures for risk control, openness to innovation in the EU’s legal system remains structurally underdeveloped.
