englischFrom the perspective of labor law, this paper addresses the question of what requirements the law of the European Union places on insolvency protection for occupational pensions and whether the national implementation law of Germany meets these requirements. Numerous implementation deficits are identified and the consequences of these deficits are evaluated. Particular focus is placed on determining the level of protection required by the law of the European Union for the insolvency protection of occupational pensions. In addition, the paper addresses relevant implementation deficits in the area of pension fund coverage, vesting periods, unregulated deferred compensation and the coverage exclusion for particularly high pensions.
