englischThis study of international crypto law creates a comprehensive overview for practitioners by systematically analyzing the issues, taking into account the technical specificities, in particular the blockchain. At the core of the work are the four issues examined, starting with mining, the issuance of new crypto assets in the context of an ICO, transactions on the secondary market, and prospectus liability in ICOs. From a legal point of view, the question of international jurisdiction under the Brussels Ia Regulation and the applicable law under the Rome I and II Regulations will be addressed in particular. In addition, aspects of capital market IPR are discussed.
Die vorliegende Untersuchung zum internationalen Kryptowerterecht schafft einen umfassenden Überblick für die Praxis, indem eine systematische Analyse der Sachverhalte unter Berücksichtigung der technischen Besonderheiten, insbesondere der Blockchain, erfolgt. Kern der Arbeit stellen die vier untersuchten Sachverhalte dar, angefangen beim Mining, der Ausgabe neuer Kryptowerte im Rahmen eines ICO, Transaktionen auf dem Sekundärmarkt und der Prospekthaftung bei ICOs. Aus rechtlicher Sicht wird vor allem die Frage der internationalen Zuständigkeit nach der Brüssel Ia-VO und des anwendbaren Rechts nach der Rom I und II-VO behandelt. Zusätzlich werden Aspekte des Kapitalmarkt-IPR erörtert.
