The entry point for the investigation was the decision of the Federal Constitutional Court on the constitutionality of the exclusion of legal entities as insolvency administrators and the inclusion of a Spanish corporation in the preselection list of a Mannheim insolvency judge. The author examines the question of admissibility from a statistical, comparative and European law perspective.

Die Frage der Zulässigkeit juristischer Personen als Insolvenzverwalter in deutschen Verfahren bejaht die Autorin. Ausgangspunkt für die Untersuchung boten die Entscheidung des Bundesverfassungsgerichts über die Verfassungsmäßigkeit des Ausschlusses juristischer Personen sowie die Aufnahme einer spanischen Kapitalgesellschaft in die Vorauswahlliste eines Mannheimer Insolvenzrichters. Die Autorin betrachtet die Frage der Zulässigkeit aus rechtstatsächlicher, rechtsvergleichender und europarechtlicher Perspektive.
Das Werk liefert interessante Auswertungen über Insolvenzverfahren und die Bestellhäufigkeit von Verwaltern in Deutschland und Spanien sowie eine umfassende Analyse der seit 2011 geltenden Regelungen des spanischen Konkursgesetzes zur Bestellung von juristischen Personen als Konkursverwalter.
