englischGeared towards scholars and practitioners, the thesis examines the capital protection in case of (limited) partnerships if no natural person is unlimitedly liable for corporate obligations. Such “atypical” (limited) partnerships are equated with corporations by means of specific legal provisions, which are aimed at supplementing the creditor protection regime. Dogmatically well-founded, the author demonstrates that specifically the capital protection is still fragmentary and develops a comprehensive and pragmatic reform proposal. Thus, the thesis does not only offer a valuable analysis of the applicable legal regime for the benefit of advisors, companies, and scholars but also a contribution to the further modernization of partnership law.
