Aljosha Barath examines how under German law professional athletes can commercialise elements of their personality, such as name, likeness, voice and signature. The author evaluates the contractual practice with regards to sponsoring, advertising, merchandising and player contracts. Since current German law does not provide for an opportunity to assign personality rights, the author proposes to introduce “personality-licenses”, which bear similarities to copyright law.
