englischGroup-wide matrix structures lead to a variety of challenges in terms of labour law. The book examines the existence of units that are eligible for works councils and shows that the common concept of an establishment predominantly leads to appropriate results even in the matrix structure. However, "virtual" matrix cells in particular can lead to a dual establishment structure. The book also focuses on the affiliation of the employees to the establishment and the works council’s participation rights in the hiring of matrix managers. The delegation of the right to issue instructions to matrix managers as well as the implementation of the matrix structure under company law and liability risks for managing directors are also discussed.
Konzernweite Matrixstrukturen führen arbeitsrechtlich zu einer Vielzahl an Herausforderungen. Die Arbeit untersucht das Vorliegen betriebsratsfähiger Einheiten und zeigt dabei auf, dass der gängige Betriebsbegriff auch in der Matrixstruktur überwiegend zu sachgerechten Ergebnissen führt. Insbesondere „virtuelle“ Matrixzellen können jedoch zu einer doppelten Betriebsstruktur führen. Weitere Schwerpunkte der Untersuchung bilden die Betriebszugehörigkeit sowie die Beteiligung des Betriebsrats bei Einstellungen insb. von Matrixmanager:innen. Auch auf die Delegation von Weisungsrechten an Matrixmanager:innen sowie auf die gesellschaftsrechtliche Implementierung der Matrixstruktur und Haftungsrisiken für Geschäftsführer wird eingegangen.
