englischThis work examines how the use of AI in the invention process affects the patentability of AI inventions. It demonstrates that only a human can be considered as an inventor, thereby making the concept of inventorship a controlling tool for determining the patentability of AI inventions. Based on these findings, it develops an examination procedure that is oriented towards the AI development process and other factors. This procedure enables the determination of the eligibility of an AI invention for protection. Furthermore, it allows for establishing the limit of protectability for AI inventions. Building on these results, it explores different possibilities for shaping the legal framework de lege ferenda.
