englischArtificial intelligence is a technological innovation seemingly associated with new opportunities and risks. Does this technological change require a new – an innovative - law in order to deal with the risks associated with AI? Based on both an analysis of the technical framework of AI and the philosophical nature of this technology, the author examines this question in the context of criminal liability for technological products. This analysis is embedded in a holistic assessment of the responsibility structures for technical products; in particular the proposed AI act and propsed changes of product liability under civil law are taken into account.
Künstliche Intelligenz ist eine technische Innovation, die mit neuartigen Chancen und Risiken verbunden zu sein scheint. Erfordert diese Neuartigkeit auch ein verändertes – ein innovatives – Recht, um die damit verbundenen Risiken bewältigen zu können? Auf Basis einer Analyse der technischen Grundlagen von KI und einer technikphilosophischen Betrachtung des Wesens dieser Technik untersucht die Autorin diese Frage im Kontext der strafrechtlichen Produktverantwortung de lege lata wie de lege ferenda. Eingebettet ist diese Analyse in eine ganzheitliche Betrachtung der Verantwortungsstrukturen für technische Produkte, so dass insbesondere die geplante KI-Verordnung sowie geplante Änderungen bei der zivilrechtlichen Produkthaftung Berücksichtigung finden.
