With the reform of the statute of limitations in 2001, German legislators shortened limitation periods and fundamentally amended the rules governing the running of the limitation period. In the interests of legal certainty and legal clarity, the legislators wanted to formulate a simple, clear and final statute of limitations. This doctoral thesis examines whether the case law adopted since the reform complies with the regulatory intentions of the legislators. It focuses on the beginning of the limitation period subject to knowledge of the claim in question and the influence on the running of the limitation period by default legal action and conciliatory proceedings. The author identifies the principles of the statute of limitations and analyses whether case law modifies the time limits provided by the legislature. Her evaluation also shows the boundaries of lawmaking by judges.
