englischThe General Data Protection Regulation aims to harmonize data protection law in the European Union. At the same time, it contains opening clauses that attribute national legislators margins of regulation to allow diversity in certain areas. This applies to the media and churches as well as to criminal law and labor law. The volume describes the European legal framework for the use of these opening clauses and the constitutional requirements in Poland and Germany. Even the constitutional situation shows considerable normative differences. The opening clauses are comparatively examined to see how they are understood and then applied. The Polish and German authors elaborate expected differences, but also surprising similarities. In this way, a minimum standard of data protection law becomes clear, which is effective in both countries and can be the starting point for the development of common European standards.

Die Datenschutz-Grundverordnung zielt auf die Harmonisierung des Datenschutzrechts in der Europäischen Union. Zugleich enthält sie Öffnungsklauseln, die den nationalen Gesetzgebern Spielräume gewähren, um auf bestimmten Sachgebieten Vielfalt zuzulassen. Dies betrifft Medien und Kirchen ebenso wie das Strafrecht oder das Arbeitsrecht. Der Band beschreibt den europarechtlichen Rahmen für die Nutzung dieser Öffnungsklausen und die verfassungsrechtlichen Vorgaben in Polen und Deutschland. Schon die Verfassungslage weist erhebliche normative Unterschiede auf. Die Öffnungsklauseln werden vergleichend daraufhin untersucht, wie sie verstanden und dann auch genutzt werden. Die polnischen und deutschen Autorinnen und Autoren arbeiten erwartbaren Unterschiede heraus, aber auch überraschende Gemeinsamkeiten. Auf diese Weise wird ein datenschutzrechtlicher Mindeststandard deutlich, der in beiden Staaten greift und Ausgangspunkt für die Erarbeitung gemeineuropäischer Standards sein kann.
