Among other things, the creator must be named as the author of a work, can protect it from modi-fication and decide on its use. Does copyright law also offer him the possibility to distance himself from a work or entire groups of works and to shape the œuvre as he sees fit? This study turns familiar thought patterns on their head. The interest of authors as well as owners such as collectors or museums in attributing and depreciating works of fine art is presented using examples from the art market and examined in terms of copyright. The author's experience from her own consulting practice as a lawyer and art historian is incorporated.
Nach traditioneller Auffassung schützt das Urheberrecht das „geistige Band“ zwischen Urheber:in und Werk. Schöpfer:in muss u.a. als Urheber:in eines Werks genannt werden, kann es vor Änderungen schützen und über dessen Nutzung entscheiden. Dabei fliessen Erfahrungswerte der Autorin aus der eigenen Beratungspraxis als Juristin und Kunsthistorikerin ein.
