englischThe German system of legal protection in German public procurement law is rather young, dynamic and remains special. Its aim is to bring the bidders’ legal protection into accordance with the principal’s interest in quick engagements. 16 years after establishing individual rights in the award procedure and the respective legal protection, the legal development has not reached a state comparable to other stipulations for legal proceedings. The treatise is - understandable even for readers not having dealt with procurement law before - not only describing the system of legal protection above and below thresholds, its characteristics in every detail and its stipulations’ interpretation orientating on the multipolar interests minding the extensive judicature, but is also discussing this system of legal protection’s compatiblity with higher-ranking law (international, European and German constitution law) and is, apart from that, showing the need for optimization and respective possibilities for improvement.
