englischPersonalized law is becoming a widespread phenomenon with digitalization. Even prices within everyday contracts can be adjusted to the individual customer through automated data analysis. This can be beneficial and open up a closed market. However, the personalization of prices and the loss in meaning of general market prices also lead to novel forms of intransparency, discrimination, and decision weaknesses. The work designs a legal control approach based on these three core dangers. The conclusion is that a responsible use of algorithms in contractual relationships can only succeed in a cooperation between humans and machines.
