It focuses on the question for which method of PID and to which extent §3a ESchG, speaking of ‘cells’ in general, applies: to the so-called ‘early’ PID that uses potentially totipotent cells or the ‘late’ PID that uses only multipotent cells.
The book debates the special role of totipotent cells, which are legally defined in § 8 ESchG as embryos. Regulatory discrepancies to other methods of reproduction medicine like abortion are discussed and also the strain on parents by the ethics commission. After a teleological and constitutional analysis, the author comes to the conclusion that the strict rule of § 3a ESchG applies in extenso to the early PID, whereas only parts of the paragraph apply to the late PID.
Das Werk behandelt die Neuregelung der Präimplantationsdiagnostik durch § 3a ESchG, der die PID unter engen Voraussetzungen zulässt. Es untersucht, für welche Verfahren der PID und in welchem Umfang § 3a ESchG, der allgemein von „Zellen“ spricht, greift. So gibt es zwei zu unterschiedlichen Zeitpunkten stattfindende Verfahren: die frühe PID an möglicherweise totipotenten Zellen und späte PID an multipotenten Zellen.
Die Arbeit setzt sich mit der aus § 8 ESchG folgenden Sonderstellung der totipotenten Zelle auseinander. Weiter werden Wertungswidersprüche zu anderen fortpflanzungsmedizinischen Regelungen, wie dem Schwangerschaftsabbruch, behandelt und auf die Belastung der Eltern durch das Verfahren vor der PID-Ethikkommission eingegangen. Nach einer teleologischen und verfassungskonformen Auslegung kommt die Arbeit zu dem Ergebnis, dass die strenge Regelung des § 3a ESchG nur für die frühe PID angemessen ist, wohingegen die späte PID teilweise aus dem Anwendungsbereich herausfällt.
