englischPrice algorithms enable companies to make automatic and reciprocal price adjustments. As a result, classic cartel constellations can be rendered obsolete by the absence of conspiratorial meetings. The dissertation shows under which conditions the use of pricing algorithms can constitute a violation of the European ban on cartels. To this end, the author analyses case constellations justifying algorithmic cooperation both directly between competitors and indirectly via a third party. Algorithm-specific compliance measures are also discussed. Finally, the practical challenges of detecting and proving such cartels are highlighted.
