If the substantive law fails to overcome the challenges of the growing normative, cognitive and temporal shortcomings, the time has come for procedural law to take over: substantive deficits could be tackled by the use of flexible, especially discursive procedural elements, and social acceptance could be enhanced through participation of the directly affected persons.
