In the context of statutory allocation, decisions to allocate health services with limited resources are equally important to consider as rationing, as they lead to redistribution. Rationing understood in this way is often found in the SHI system at various decision-making levels of joint self-administration. It follows certain - already known - rationing criteria. In view of the generational change, this raises both constitutional and moral-philosophical questions about the further development and application of these rationing mechanisms – beyond the decision on life and death. This book approaches these questions.
Rationierung ist mehr als nur Vorenthaltung. Im Rahmen staatlicher Zuteilung sind unter dem Thema Rationierung auch zuwendende Leistungsentscheidungen bei begrenzten Mitteln von Bedeutung, da sie zu Umverteilung führen. Die so verstandene Rationierung findet sich im System der GKV auf verschiedenen Entscheidungsebenen der gemeinsamen Selbstverwaltung vielfach wieder und folgt dabei bestimmten – bereits bekannten – Rationierungskriterien. Es stellen sich in Ansehung des Generationenwandels damit sowohl verfassungsrechtliche als auch moralphilosophische Fragen nach der Fortentwicklung und Anwendung dieser Rationierungsmechanismen, auch abseits der Entscheidung über Leben und Tod. Diesen Fragen nähert sich diese Arbeit.
