englischAs early as the second half of the last century, the vision of systems that could support medical decisions or even replace them emerged. Today, enormous progress is visible in information technology, such evolution being discussed, in particular, using the buzzword "artificial intelligence". Nevertheless, there is little in-depth legal literature on the use of automated systems in medicine. This work therefore addresses the processing of data, information and knowledge to support or replace medical decisions. The focus of the analysis lies on the legal regulations related to the medical profession and treatment relationship and to data, information and confidentiality.
Bereits in der zweiten Hälfte des letzten Jahrhunderts entstand die Vision von Systemen, die Hilfestellung bei ärztlichen Entscheidungen bieten oder sie sogar ersetzen können. Heutzutage sind enorme Fortschritte in der Informationstechnik sichtbar, die insbesondere unter dem Schlagwort „Künstliche Intelligenz“ diskutiert werden. Dennoch existiert nur wenig umfassende rechtswissenschaftliche Literatur zum Einsatz automatisierter Systeme in der Medizin. Die Arbeit beschäftigt sich daher mit der Verarbeitung von Daten, Informationen und Wissen zur Unterstützung bzw. dem Ersetzen ärztlicher Entscheidungen. Der Fokus der Untersuchung liegt auf berufs- und behandlungsbezogenen und daten-, informations- und geheimnisbezogenen rechtlichen Regelungen.
