englischIn its 2017 judgements “CTL Logistics” the EJC declared an independent civil court review of the equity of charges for the use of railway infrastructure that are subject to regulation to be inadmissible. The volume analyses the consequences of this judgment for competition law. In particular, it scrutinizes whether Article 102 TFEU, with regard to the ECJ-decision “Deutsche Telekom” and “Crehan/Courage”, can still be applied in stand alone-trials can by the civil courts as the German FCJ (BGH) has expressed in its “Trassenentgelte”-judgment of 2019. The volume contains an expert opinion for DB BNetz AG.
