englischTelecommunications and energy networks are the lifelines of modern societies and future-oriented economies. Since these networks are natural monopolies, they must be regulated by the state. Although this regulation is now legally detailed, it is nevertheless confronted with very fundamental questions: How are the interests of network operators and network users to be balanced? To what extent may a regulatory authority intervene in the rights of the network operator? To what extent must network expansion be supperted and guaranteed? How independent may a regulatory authority be?

This work shows how the guiding principle of efficiency can be transferred from economics to law and how it offers clear answers to these current regulatory questions, especially in recourse to constitutional law.
