englischThe thesis examines fundamental legal principles, which particularly concern the prerequisites of liability similar to contract and the protective obligations within a particular relationship under German law. The author brings together and further develops the existing principles of protective obligations in a meaningful way by focusing on the trilateral relationship of the parties involved in linked contracts. Based on the understanding of civil law as a legal assignment order, the author specifies this doctrine with elements of legal spheres and enriches the long-standing discussion with new elements.
Die Arbeit thematisiert dogmatische Grundlagen zu den Voraussetzungen einer rechtsgeschäftsähnlichen Haftungsgrundlage und den Schutzpflichten innerhalb einer Sonderverbindung. Dabei gelingt es dem Autor, die bestehende Schutzpflichtendogmatik sinnvoll zusammenzuführen und fortzuentwickeln, indem er seinen Fokus auf die trilaterale Beziehung der Beteiligten bei verbundenen Verträgen richtet. Aufbauend auf dem Verständnis des Zivilrechts als Rechtszuweisungsordnung präzisiert der Autor diese Lehre mit Elementen der Rechtskreisöffnung und bereichert die seit langem bestehende Diskussion mit neuen Aspekten.
